LASTING POWER OF ATTORNEY

On average, there are almost 20,000 applications (a staggering number!) made to the Office of the Public Guardian to register a Lasting Power of Attorney each week.

It is shocking to see that just over half the number of applications made to the Office of the Public Guardian are successful.
Here at TLC, we have a 100% success rate!

What is a Lasting Power of Attorney?

Simply, it’s giving someone you know and trust the ability to make decisions for you if you lose mental capacity in the future or even if you would prefer them to make decisions for you now.

Why is it important?

We are all living longer and statistics show that 1 in 3 of us will develop Dementia. It is vital to release the burden from loved ones to allow them to access your money and pay for care for example. Banks can freeze accounts if capacity is lost, regardless of account signatories and medical professionals make decisions for you without having to consult your loved ones. A Lasting Power of Attorney negates these issues.

What’s involved?

We will do all the work for you. We just need an hour of your time to explain everything to you, take down all your requirements, answer all your questions and then we’ll do all the work in the background. We then return to you with all the forms for signing, contact all your attorneys on your behalf and liaise with the Office of Public Guardian to make your Powers official.

Enduring Power of Attorney

You may have created an Enduring Power of Attorney prior to October 2007…

If you did this can still be used (as long as it was signed correctly and is legal!).

An Enduring Power of Attorney only relates to Property & Financial Affairs and so any Attorney appointed cannot take Health & Welfare decisions, a Lasting Power of Attorney must be put in place to do this.

An Enduring Power of Attorney can be used whilst you still have capacity if you would like your Attorney to act for you BUT once you have lost capacity it MUST be registered.
