What is Probate?

Probate is the process of dealing with someone’s estate when they pass away, including the collecting in of assets (property, money and personal possessions) and distributing them to beneficiaries. 

Where do I start?

This will depend on whether the deceased had a Will or not. If the deceased had a Will the Executors will need to begin by obtaining a Grant of Probate, if there is no Will then we will need to apply for Letters of Administration. These are legal documents to allow the estate of the deceased to be administered in accordance with the Will (if there is one) or by the rules of intestacy.

What’s involved?

We can provide assistance with the process, help with applying for and obtaining the Grant of Probate or Letters of Administration, assist with the finding and collection of assets (including selling of property), advising in relation to the payment of Inheritance Tax, distribution of the estate and sorting out the estate accounts.
